First New Mexico State Police Officer on Leave in Connection to ‘DWI Enterprise’ Scandal


New Mexico State Police Sergeant Toby Lafave has been placed on administrative leave as part of the ongoing investigation into the “DWI Enterprise” scandal. Lafave, known for his impressive DWI arrest record and previous accolades, has been added to the Giglio List by the Bernalillo County District Attorney, making him not considered a credible witness in court. The DA has dropped 230 cases involving officers implicated in the scandal and is currently reviewing Lafave’s cases for potential dismissal.

State Police Chief Troy Weisler has stated that any misconduct or criminal behavior within their ranks will not be tolerated, and those found violating the law or policies will be dealt with swiftly. Former State Police Chief Pete Kassetas expressed disappointment in Lafave’s involvement in the scandal and praised Chief Weisler for addressing the situation. The New Mexico Department of Transportation stated that officer participation in their campaigns is at the discretion of the State Police and did not comment on Lafave’s previous involvement.

Defense Attorney Thomas Clear III and former APD Officer Neill Elsman have pled guilty to racketeering charges related to the scandal, along with other former law enforcement officers. Each individual who has pled guilty admitted to the involvement of multiple law enforcement agencies in the “DWI Enterprise.” The Bernalillo County Sheriff’s Office has also placed an officer on leave in connection to the scandal.
