Court prohibits US from transferring Venezuelan asylum seekers to Guantánamo


A federal judge has put a halt to the U.S. government’s attempt to send three detained Venezuelan men to Guantánamo Bay, Cuba. The men, who are being held at an Immigration and Customs Enforcement facility in New Mexico, sought a temporary restraining order to prevent their transfer as part of the Trump administration’s new policy. Judge Kenneth J. Gonzales of the Federal District Court for New Mexico quickly granted the restraining order, following a hearing held by videoconference.

The legal challenge brought by the men’s lawyers is the first against the administration’s policy of sending undocumented migrants to Guantánamo. While immigration and human rights advocates have been unable to challenge the policy due to lack of information about other detainees sent to Guantánamo, the Venezuelan men were already represented by lawyers and filed their complaint expressing fear of transfer.

The men alleged that they were being held in the same ICE facility where previous groups of detainees were flown to Guantánamo. They recognized some of the faces of these detainees from government photographs provided to the media. The court’s decision serves as a temporary victory in the ongoing debate surrounding the treatment of migrants under the Trump administration’s policies.
