In a recent development, the Bernalillo County District Attorney’s office was forced to dismiss 17 DWI related cases due to the infamous DWI scandal in Albuquerque. This brings the total number of dropped cases to 230 since last year, all due to arresting officers being added to the 2nd judicial district’s Giglio List. The list is frequently updated and can be found on the DA’s website.
Among the latest cases dismissed, 13 were tied to BCSO Deputy Jeff Hammerel and four were related to retired DWI Officer Timothy McCarson. Since January 2024, a total of 230 cases have been dropped, with the majority stemming from five APD DWI officers.
As of now, no officers from the New Mexico State Police have been formally named in the scandal by the United States Attorney’s Office or the Bernalillo County District Attorney’s Office. Additionally, as of February 3, no officers or deputies have been formally charged in the case. Ricardo Mendez, also known as Rick, has pleaded guilty to multiple federal charges related to the DWI scheme and is awaiting sentencing.
This ongoing scandal has raised concerns about the integrity of law enforcement in Albuquerque and the handling of DWI cases. The dismissal of cases due to officer misconduct is a concerning trend that could have far-reaching implications for the justice system. Stay tuned for further updates as the investigation unfolds.
