Emily Hernandez, a Missouri woman who was convicted in the Jan. 6 Capitol riot and recently pardoned by President Donald Trump, was sentenced to 10 years in prison this week for killing a mother of two in a drunken-driving crash. In the Capitol riot, Hernandez was seen holding the broken nameplate of then-House Speaker Nancy Pelosi. She served 30 days in federal prison for her involvement in the riot and was then released.
In the state court of Missouri, Hernandez was sentenced for a drunken-driving crash in 2022 that killed Victoria Wilson and seriously injured her husband, Ryan Wilson. Hernandez pleaded guilty to one count of driving while intoxicated in which a person died and another count in which a person was seriously injured. She was driving the wrong way on an interstate when she crashed into the Wilsons, who were celebrating their wedding anniversary.
The victim’s mother expressed her grief over losing her daughter and is left with an empty hole in her heart. Hernandez’s blood-alcohol content was recorded at .125 during the crash. Her defense attorneys argued for a shorter sentence, stating that she acknowledges her actions and is remorseful.
Trump issued pardons or commutations for everyone convicted in the Jan. 6 Capitol riot, including Hernandez. While most received unconditional pardons, some had their sentences commuted, including Hernandez. She pleaded guilty to a federal count of entering and remaining in a restricted building or grounds, and was sentenced to 30 days and one year of supervised release.
