The New Mexico Supreme Court made a landmark decision in the case of State of New Mexico v. Board of County Commissioners for Lea County, ruling unanimously against anti-abortion laws in Lea and Roosevelt counties and the cities of Hobbs and Clovis. Attorney General Raúl Torrez led the charge to challenge the laws, with the court also considering the Reproductive Health Care Freedom Act, which prohibits public bodies from denying reproductive rights.
The decision was hailed by organizations such as Eastern New Mexico Rising, Tewa Women United, Equality New Mexico, and Planned Parenthood of the Rocky Mountains, who praised the court for upholding reproductive rights. The ACLU of New Mexico also supported the ruling, denouncing the unconstitutional ordinances as an attack on New Mexicans’ rights.
The decision sets a precedent for protecting reproductive rights across the state, ensuring that all individuals have access to the healthcare they need without interference from local governments. New Mexico remains dedicated to upholding reproductive health, rights, and justice for all residents.
