Local Abortion Restrictions Rejected by New Mexico Supreme Court

The New Mexico Supreme Court has ruled against local ordinances in Hobbs, Clovis, Lea, and Roosevelt counties that sought to restrict access to abortion services. The ordinances were created in response to the U.S. Supreme Court decision to end the federal right to abortion. The local laws cited the Comstock Act, which banned the mailing of abortion-related materials, as the basis for their restrictions. However, the state Supreme Court deemed the ordinances invalid, stating that they went beyond federal requirements and interfered with access to reproductive healthcare. This decision comes after New Mexico signed the Health Care Freedom Act in 2023, which prohibits interference with access to reproductive and gender-affirming care. The ruling by the state Supreme Court is seen as a victory for reproductive rights advocates, who have been fighting against restrictive abortion laws in various states. It reinforces New Mexico’s commitment to protecting access to essential healthcare services for its residents.
