President-elect Donald Trump and his former co-defendants in the Florida classified documents case are seeking to block the release of a final report by special counsel Jack Smith, who prosecuted the case. The defendants argue that Smith’s appointment was unconstitutional and that his report will be biased and one-sided. Trump’s lawyers sent a letter to Attorney General Merrick Garland asking him to stop Smith from releasing the report, calling Smith an “out-of-control private citizen.” They also reviewed a draft copy of the report over the weekend. Smith and his team plan to resign before Trump takes office. The Justice Department charged Trump with mishandling classified documents in Florida, but the case was dismissed in July due to Smith’s illegal appointment. Trump pleaded not guilty. Smith also had to end the election interference case against Trump after indicting him in 2023 for trying to overturn the 2020 election. The charges against Nauta and De Oliveira are still being appealed after being dismissed by Cannon. The Justice Department, so far, has not commented on the situation.
