A death row inmate named Melissa Elizabeth Lucio, convicted of killing her toddler daughter in 2007, has been declared “actually innocent” by Cameron County District Court Judge Arturo Nelson. The judge stated that Lucio should be freed from custody as she has provided clear and convincing evidence of her innocence. Lucio has 13 surviving children and her case has drawn attention from advocates such as Kim Kardashian, Amanda Knox, and State Rep. Jeff Leach. There is new evidence suggesting that the fatal injuries to Lucio’s daughter were caused by a fall down a staircase, and not by abuse as previously believed. The Texas Court of Criminal Appeals is now reviewing the case, which had initially scheduled Lucio’s execution for April 27, 2022. The district attorney of Cameron County supports Lucio’s appeal, stating that she should not be put to death for a crime that never occurred. Lucio’s lawyer from the Innocence Project, Vanessa Potkin, is calling for her release after 16 years on death row.
